Since 16th March, 2022 the applicant is residing out of Ahmednagar District as per the bail condition. There were no complaints against the applicant that he had breached the bail conditions. The situation in the village where the incident happened is presumed to be normal. The applicant is an agriculturist and his family is residing at village Kurund Taluka, Parner, District Ahmednagar.

The learned counsel for the applicant would argue that, it is difficult for the applicant to stay away from Ahmednagar District. His family is suffering a lot. He undertakes not to disturb anybody or

Considering the facts of the case, the application deserves to be allowed. Hence, the following order.

ORDER

(i) The application is allowed (ii) The condition No.2 (d) imposed upon the applicant by the order dated 16th March, 2022 in Bail Application No. 218 of 2022 by this Court stands relaxed with a condition that the applicant shall furnish an undertaking to maintain law and order till conclusion of the trial.
