Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

Admittedly, the victim and the applicant had love affair. They were working in the same department. They were in relationship for substantial period. The victim has grievance that the applicant did sex with her under the promise to marry her, but he hide his marriage. In view of the facts of the case, further detention of the applicant may not be fruitful. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Sandip Ashok Gande be released on bail, on furnishing

B. and S.B. of Rs. 50,000/- (Rupees Fifty Thousand only), with one solvent surety of the like amount, in Crime No.20 of 2023, registered with Gangapur Policle Station, District Aurangabad, for the offences punishable under Sections 376 (2)(n) and 506 read with Section 34 of the Indian Penal Code, on the conditions that, (a) The applicant shall not contact the victim till the conclusion of the trial.

(b) He shall attend the police station as and when called by the Investigating Offier on written notice, till filing chargesheet. ( S. G. MEHARE ) JUDGE ysk
