This is the Application for condonation of 1130 days delay in preferring First Appeal against the Judgment and Award dated 17.10.2018 passed by the learned Reference Court in L.A.R. No.669/2015.

Pursuant to notice issued to the Respondents, learned AGP appears for Respondents No.1 and 2 and learned Advocate Shri. Rahul A. Tambe appears for Acquiring Body.

The learned Advocate for the Applicant submits that due to financial constraints and drought situation in the area where the

Applicant is residing, he could not approach this Court within the prescribed period. He submits that the Application be allowed. 4.

The Application is opposed by the learned AGP and the learned Advocate for the Acquiring Body. They submit that, no sufficient reasons are mentioned in the Application.

Perused the Application. For the reasons mentioned in paragraph no.3 of the Application, the Application is allowed in terms of prayer clause 'B', subject to the condition that the Applicant / Appellant shall not be entitled for the statutory benefits and the interest for the said delayed period. Civil Application stands disposed of accordingly. 6.
