Though various contentions are raised in the petition by the petitioner and also through reply by the respective respondents, on perusal of the order passed by the State Government in its School Education Department, it appears that while granting permission of shifting school in favour of the respondents No.6 and 7, no reasons whatsoever have been assigned in the light of the policy of the State Government as reflected in the
2905.14wp Government Resolution dated 31 st July, 2013 issued by the Education & Sports Department, Mantralaya, Mumbai.
In that view of the matter, we deem it appropriate to direct the Secretary or Deputy Secretary, as the case may be, to hear the petitioners and also the respondents and take appropriate decision, in accordance with the Government Policy and in particular, as reflected in Government Resolution dated 31 st July, 2013, as expeditiously as possible and preferably on or before 30 th May, 2015 and we direct accordingly.
Till the decision is taken by the respondent - authority, parties shall maintain status quo about existence of respondent No.7 school. It is needless to observe that since the impugned order suffers from not assigning reasons for transfer of the school, the same order would not be acted upon after next decision which will be taken by the State Government.
Petition stands disposed of, accordingly.
