Mr P.B. Rakhunde, learned counsel for the applicant seeks leave to place on record certified copy of the compromise letter arrived between the parties before the executing court/M.A.C.T., Latur. Leave granted. 2.

The copy of settlement letter is taken on record and marked as 'X' for identification.

Mr Rakhunde, learned counsel for the applicant submits that the matter has been amicably settled between the parties and these applications and the appeals on stamp number may be disposed of as withdrawn. 4.

Mr Syed Daniyal Hussain holding for Mr S.G. Chapalgaonkar, learned counsel for respondent No. 2 and Mr F.K. Patel, learned counsel for original claimant/respondent No.1 have no objection to dispose of these applications and the appeals on stamp number in view of the settlement between the parties.

Having regard to the submissions of the learned counsel for the respective sides, I proceed to pass the following order :-

ORDER

(i) The civil applications and the first appeals on stamp number are hereby disposed of as withdrawn in view of the amicable settlement between the parties.

(ii) No order as to costs.

(iii) The court fee refund certificate be issued in favour of the applicant as per rules.
