Mr. Rudrawar, the learned counsel submits that, the proposal was given to respondents in the year 2009 for starting the school from Vth to VIIth standard. No decision has been taken on the same. Even reminders are issued every year. No cognizance is taken by respondents.

We have heard the learned Assistant Government Pleader also.

After introduction of the Right to Education Act, which is applicable for Ist to VIIIth standards, the parameters have

2 wp 2399.15 changed. It would not be fruitful to direct the respondents to consider the proposal of the petitioners to start Vth to VIIth standard school filed in the year 2009. The petitioners, if so advised may file a fresh proposal, in accordance with law and as per the requirement of the policy and the respondents in case such proposal is filed shall consider the said proposal on its own merits as per the policy and the norms expeditiously and preferably within a period of three (3) months from the date of receipt of the proposal.
