Learned counsel Mr. R. R. Imale, holding for Mr. A. S. Usmanpurkar, learned advocate for the appellant/Insurance Company, learned counsel Mr. B. V. Dhage for the respondent Nos. 1 and 2/original claimants along with original claimants are present today. They tender on record terms of settlement, which are taken on record and marked as 'Exhibit - X' for identification. 3.

With the assistance of learned counsel we have ascertained the identification of the original claimants/respondent Nos. 1 and

2. They admit/confirm the terms of settlement and agree for the final disposal of the first appeal.

The first appeal stands disposed of in terms of settlement Exhibit - X.

The respondent Nos. 1 and 2/original claimants shall be entitled to receive an amount of Rs. 19,00,00/- (Rs. Nineteen Lakhs only) towards full and final settlement, which shall be disbursed to the respondent Nos. 1 and 2/original claimants from the amount deposited in this Court. Balance amount along with interest shall be disbursed to the appellant/insurance company. 6.

A request for refund of court fees shall be processed in accordance with law.
