The learned advocate for the appellant had filed Civil Application (Stamp) Nos.7533/2021 and 7534/2021 in order to bring on record legal heirs of the sole appellant and sole respondent respectively. The office had raised objections in both the Civil Applications. The objections were not removed within stipulated period. In the result, registration of both the Civil Applications came to be refused.

In turn, the office has placed the Second Appeal in order to pass the order of abatement. As per the record, there is a sole appellant and sole respondent. According to learned advocate for the appellant, both have been died. In the circumstances, as their legal heirs are not brought on record within stipulated period, 74 SECOND APPEAL NO.1100 OF 2005

the second appeal deserves to be disposed of as abated. In turn, the following order.
