By the impugned order dated 24.01.2024, the learned Additional Commissioner, Aurangabad has rejected prayer for amendment in the notes of arguments filed on record by the appellant i.e. present petitioner.

The learned counsel for the respondents in fairness submit that they have no objection for allowing the petition in as much as a party is entitled to raise all grounds and contentions as he may desire in the notes of arguments and the other side will have adequate opportunity to deal with the same.

In terms of the above, impugned order dated 24.01.2024 is Narwade

951-wp-3790-2024 -2quashed and set aside and permission is granted to the petitioner/ original appellant to amend the notes of arguments filed before the learned Appellate Authority.

The appellate authority is directed to decide the Appeal on or before 31.12.2025.

5.

Writ petition disposed of accordingly.
