The learned counsel for the respondents submit that in fact the order dated 20.10.2016 pursuant to which the contempt petition is filed is not an order which could be executed, in fact the prayer in the writ petition no. 7017 of 2016 was seeking direction against the Management to submit the proposal of the petitioner for approval as a Headmaster. This Court under order dated 14.10.2016 directed the respondent no.3 therein i.e. the Education Officer to decide the proposal, in fact proposal was never submitted by the institution. 2.

As the proposal was never submitted by the institution, there would be no occasion for the Education Officer to take decision on any proposal. The petitioner ought to have taken appropriate steps.
