It appears that advocate for the applicant is consistently absent in this matter. This Court in the order dated 6.6.2023 noted that on last three occasions none appears for the applicant. Hence, the matter is adjourned for today, as a last chance. However, none present for the applicant.

Learned counsel for respondents would point out that the present application is filed seeking condonation of delay of almost 9 years challenging the award passed by the Tribunal in favour of the respondents. He would submit that the applicant was directed to deposit the entire amount of award in this court by order dated 8.9.2022, however, it is not complied with. It is apparent that, the applicant is simply prolonging the proceeding and killing the time in releasing the awarded amount. In that view of the matter, the application is dismissed for want of prosecution. Consequently, the first appeal stands disposed off.
