In view of the judgment in Criminal Writ Petition No.1485 of 2013 which is in turn based on judgment of the Supreme Court in the case of State of Haryana and Ors. Jagdish (2010) 4 SCC 216 and amended Rule 16 of the Prison (Bombay Furlough & Parole) Rules, 1959, we are inclined to allow this petition as prayed for.

Petition is allowed in terms of prayer clause "C". The learned Counsel for the petitioner who is appointed as amicus curiae be paid Rs.1500/- (Rupees One Thousand Five Hundred) as legal fee.
