BENCH AT AURANGABAD 908 CIVIL APPLICATION NO. 12426 OF 2017 IN RAST/5459/2017 VITTHAL ARJUNRAO BUDDHE
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Applicant : Mr. Patil Indrale Anand V. AGP for Respondents/State : Mr. S.B. Joshi ...
CORAM : S.S. SHINDE & MANGESH S. PATIL, JJ.
DATE :

Heard the learned counsel appearing for the applicant. He submits that since the applicant was disappointed and depressed and was under depression he could not take immediate steps to file the review application.
2.
Since the applicant has not placed on record any documents showing that he was really suffering from depression and that he had taken some treatment, there is an inordinate delay of 505 days which remains specifically unexplained. It is true that when there is a prayer for condonation of delay, the length of delay itself is not the factor to reject the prayer for condonation of delay. However, in the present case
( 2 ) 908 ca 12426.17 nothing is placed on record to show that the petitioner was really suffering from depression and some treatment was taken by him. 3.
For the reasons aforesaid, we are not inclined to entertain the application for condonation of delay and the same stands rejected. Consequently, there is no question of entertaining the review application. [MANGESH S. PATIL, J.] [S.S. SHINDE, J.] mub
