In this Public Interest Litigation, on the basis of general and vague pleadings prayer is that the State Government be directed to cause an enquiry in the alleged irregularities and illegalities committed while constructing 12 k.m. road on Dudhna Dam Site project. 2.

By order dated 17th February 2015, this Court directed the respondent No. 2-The Chief Engineer and Chief Administrator of Command Area and Development Authority to cause an enquiry in the matter. Reply is filed on behalf of respondent No. 2 and alongwith it copy of enquiry report is placed on record. In the enquiry report it is stated that case of fraud or

( 2 ) pil23.13 embezzlement of government fund or repeating of work is not noticed in the enquiry. The enquiry report is submitted by the Chief Engineer and Chief Administrator, Command Area and Development (W.R.), Aurangabad. There is no reason to disbelieve the enquiry report and the submission made on affidavit in the reply filed by respondent No.2, especially when the petitioner has not been able to point out any specific instance of irregularities or illegalities. Hence, we see no reason to keep this Public Interest Litigation pending. Hence Public Interest Litigation is dismissed. In the circumstances, the parties to bear their own costs. [S.M.GAVHANE,J.] [Z.
