6th March, 2018 PER COURT:- 1) While considering the application under Section 41A of the Maharashtra Public Trust Act, 1950, presented by the respondents, the Assistant Charity Commissioner, Dhule, has directed that the incoming Trustees would look after day-to-day administration of the Trust and operate the bank account jointly in accordance with the provisions of the constitution of the Trust till the new managing committee is legally constituted. It is further directed to the committee not to take any policy decision in respect of sale of property,

{2} 904 - WP 2332 of 2018 appointment of new staff till the final decision of Change Report proceedings bearing No.95 of 2018.

2) The petitioners herein have objected to the change proposed in Change Report proceedings bearing No.95 of 2018.

3) The order passed by the Assistant Charity Commissioner does not cause any prejudice to either of the parties and the said order would facilitate the smooth functioning of the school operated by the Trust.

4) The learned counsel appearing for the respondents, on instructions, states that until the disposal of Change Report proceedings, the incoming Trustees would look after the day-to-day administration of the Trust and would not spend the amount except for payment of salary to the employees and for the purpose of day-to-day

5) In view of the above, the Assistant Charity Commissioner is directed to dispose of Change Report proceedings as expeditiously as possible and preferably within eight months from today. 6) Accordingly, writ petition is disposed of.
