Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No. 82 of 2023 registered with Vivekanand Chowk Police Station, Latur, District-Latur, for

the offence punishable under Sections 302 and 504 of the Indian Penal Code.

The incident happened during religious procession. One of the boy was pushed during the procession while dancing. Fortunately, the entire incident was captured in the CCTV. It has been alleged against the applicant that he has stabbed the deceased. However, the CCTV Footage, which has been watched by the counsel for the applicant. The learned APP, on instructions, states that CCTV Footage does not show that the applicant has stabbed the injured or deceased. 4.

Learned counsel for the applicant submits that deceased has received injury of punctured stab wound over lower abdomen at right side. In the said incident, the applicant also suffered injuries. It was big mob and the great commotion took place. Knife has been recovered from the witness. 5.

Considering the incident and the period which would be taken for completion of the trial, the Court is of the view that the applicant deserves bail. Hence the following order:-

O R D E R

(I) Bail Application stands allowed.

(II) The applicant - Jaid S/o Jahed Sayyad be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in the above crime, on the condition that:- (a) The applicant shall stay away from Latur town for three months from the date of his release. (b) The applicant shall not tamper with the prosecution witnesses.

(c) The applicant shall attend the trial on each and every effective date.
