Respondent No.2 Ashrubai died. She is survived by heirs shown in the title clause of the application. She was original defendant. The cause of action survives against legal heirs. They are necessary parties.

There is no reason to find fault with the application. Its averments are not controverted.

Civil application stands allowed in terms of prayer clauses "A, B, C".
