The Petitioner is a life convict, undergoing sentence in Open Prison of Paithan. According to the Petitioner, since he has
cwp251.16 completed 23 years of imprisonment, he deserves to be released from custody. He is trying to suggest that his case would fall in Category No.2(a) of Government Resolution dated 15th March 2010. But the Government has opined that having regard to the facts of the Petitioner's case in which he was convicted, crime was committed against a woman with exceptional violence and with brutality. 2.
We have perused the Judgment of the trial Court. We have also perused the papers and we are convinced that the case of the Petitioner would fall in Category 2(c) of the Government Resolution. We are, therefore, not inclined to interfere in the impugned order. The Writ Petition is rejected.
3. Fees of the appointed counsel be paid as per Rules.
