2] The applicant, who is arrested in Crime No.252 of 2015 registered at Osmanpura Police Station, Dist.Aurangabad for the offences punishable under Section 342 and 394 of Indian Penal Code, is praying for his release on bail.
3] The complaint filed by the complainant would show that two unknown persons had barged in the
2 8-crappln1121-16.odt house of the complainant on 14th October, 2015 in the noon time. They locked the door from inside. Thereafter, they tied the complainant with a rope, gagged his mouth by an handkerchief and by putting point of knife on his neck, looted the property of the complainant of Rs.1,45,000/-.
4] The investigation papers would show that present applicant was identified by the complainant during the test identification parade. Further, according to the prosecution, the stolen articles were recovered at the instance of the present applicant.
5] Learned counsel for the applicant submits that certain supervening circumstance viz. death of father of the applicant has occurred and therefore, he submits the applicant may be released on bail.
