This application is filed for transfer of proceeding bearing No. A-41 of 2023 pending in the Family Court, Jalna to the Court of learned CJSD, Wardha. The ground on which transfer is sought is that the wife stays with child of three years. Distance between two places is more than 300 kms. There is no one to accompany her to attend the Court proceeding.

Learned Advocate for the respondent has vehemently opposed the application. He submits that he is ready to bear expenses of the wife, whenever she comes to Court. The proceeding is instituted in the Court having jurisdiction. No exceptional ground is made out for transfer of the proceeding.

However, looking to the fact that one proceeding is already pending in the Court at Wardha under the Protection of Women from Domestic Violence Act filed by the applicant, which the respondent has to attend, this Court is inclined to allow the application. 04.

The application is, therefore, allowed in terms of prayer clause (B) and disposed off.
