Dispute between the parties arises out of purchase order dated 23.04.2022 Clause-12 of the purchase order provides for resolution of disputes by way of arbitration. Perusal of Clause 12 will demonstrate that both the parties, namely, the present applicant and respondent are to appoint one Arbitrator each and the two appointed Arbitrator are then required to appoint third Arbitrator.

The applicant has vide notice dated 10.11.2024 appointed Advocate Mr. Subodh Shah as an Arbitrator on its behalf and called upon respondent to suggest the name of the Arbitrator to be appointed on its behalf. The respondent has not filed reply to the notice dated 17.11.2023 issued by the applicant.

The respondent is duly served in the present matter as can be seen from the office note dated 05.12.2024. A period of around 9 months has lapsed since then, however, there is no appearance on behalf of respondent. In view of the above, Mr. Pratap Mandlik is appointed as an Arbitrator on behalf of respondent. 4.

Application is disposed accordingly.
