At the outset learned counsel for the respondent raised objection about tenability of the petition.

After hearing the learned counsel for the petitioners substantially on the last of hearing as well as today the learned counsel for the petitioners was unable to satisfy the Court that criminal writ petition is maintainable in respect of the order passed under the provisions of Employees Provident Funds and Miscellaneous Provisions Act, 1952.

Learned counsel for the petitioners now seeks leave to withdraw the petition for filing appropriate proceeding to challenge the 69.criwp267.23.odt

said order of issuance of warrant of arrest against the petitioners to lodge him in civil prison. Petition is dismissed for want of jurisdiction with liberty as prayed.
