CORAM : SMT. VIBHA KANKANWADI, J.
DATE : 30TH JULY 2019 ORAL ORDER :
01.
Present applications have been filed by the claimants for getting delay of 882 days condoned in filing first appeals. The claimants intend to challenge the judgment and award passed by the reference Court for enhancement.
02.
Learned Assistant Government Pleader representing respondent no.01 strongly opposes the applications on the ground that the reason that has been mentioned for condonation of delay is not sufficient and reasonable.
(Order) (2) C.A. No. 8822 of 2013 & Group 03.
Taking into consideration the fact that the applicants are agriculturists, coming from rural area and whose lands were acquired; leniency is required to be shown and hence the delay stands condoned. The applications stand allowed and disposed of. It is clarified that the applicants are not entitled to get interest of 882 days in case of success in their appeals. Registry to verify and register the first appeals and place them for further consideration on 18th November 2019.
