1.

It is submitted that the petitioner has been given admission in respondent No.3 College from Scheduled Tribe Category. Validation proceedings are pending with the Committee. However, respondents 2 and 3 are not accepting the examination form of the petitioner on the ground that validity certificate is not produced.

We have heard learned AGP for the respondents State.

To get the validation proceedings decided within a stipulated period is not in the hands of litigants.

Considering the above, we pass following order: 1/2

O R D E R

(a) The Committee shall decide the validation proceedings in respect of tribe claim of the petitioner expeditiously, preferably within eight months. The petitioner shall cooperate in expeditious disposal of the said proceeding.

(b) Till the validation proceedings are decided, respondent Nos. 2 and 3 shall not refrain the petitioner from prosecuting further studies only on the ground that validation proceedings are pending.

Of course, respondent Nos. 2 and 3 can take further course of action depending upon the judgment that may be delivered by the Committee in the validation proceedings.

Writ petition is accordingly disposed of. No costs.
