The learned advocate for the applicant, on instructions seeks leave to withdraw the application with permission to file the application, if the trial is not concluded within six months. 3.

Leave granted. The application is dismissed as withdrawn. 4.

If the trial is not concluded within six months, the applicant is at liberty to file the application for bail before the trial Court. 5.

The trial Court is directed to conclude the trial as expeditiously as possible and in any case within six months from today. The trial Court shall conduct this case as expeditiously as possible by keeping it twice or thrice in a week. Needless to mention, it is a session as well as special case. The session means once it is started, it should not be stopped till the conclusion of trial. If the

324.2024BA -2applicant- accused or his advocate are not cooperating for conducting the trial, the trial Court may impose heavy costs upon the accused. If the applicant-accused is not produced before the trial Court, the trial Court may conduct the meeting by calling the district jail authority, Jalna as well as head of escort parties and direct them to produce the accused on each and every day. If those directions are not followed by the authorities, the trial Court may proceed against these two authorities as per Chapter X of the Indian Penal Code for contempt of lawful authority etc., without reference to this Court.

Fees of Ms.Namita Sirdeshpande, learned appointed advocate to represent the cause of respondent no.2 shall be paid through the High Court Legal Services Sub-Committee, Aurangabad, as per rules and schedule.
