Petitioner is challenging the order dated 12.02.2016 passed by 3rd Joint Civil Judge, Senior Division, Latur, below Exhibit-58.

Petitioner had filed election petition. During the pendency of election petition, 3rd Joint Civil Judge, Senior Division, Latur has passed 'evidence close' order. Petitioner had filed application seeking recall of said order, which was rejected. Hence, the present writ petition.

Learned advocate for the petitioner submits that due to passage of time, writ petition has become infructuous. He Bhagyawant Punde

{2} 921-wp-2985-2016 submits that while issuing notice, this Court directed the petitioner to deposit an amount of Rs. 15,000/- in the Trial Court to show his bonafide.

Due to passage of time, writ petition has become infructuous and same is disposed of as such.

5.

Petitioner is at liberty to file application before the Trial Court for withdrawal of amount.
