This application is filed by the applicant-wife seeking transfer of matrimonial proceeding bearing Hindu Marriage Petition No.A1202/2024, pending before the learned Judge, Family Court-6, Pune to the Court of learned CJSD, Omerga Dist. Dharashiv/Osmanabad. 4.

It is the case of the wife that, she is residing at Bedga Tq. Omerga Dist. Dharashiv with her old aged parents. The distance between two

( 2 ) places is around 350 kms. She find it difficult to travel to Pune as she is residing with her two years child. There is no one to accompany her to go to Pune. The wife has already initiated the proceeding bearing PWDVA No.46/2021 before the learned Court at Omerga. The learned Advocate for the applicant therefore prays for allowing the application. 5.

Considering above position, this Court finds that to avoid conflicting judgments and for the convenience of the wife, the proceedings needs to be transferred.

ORDER

(i) Misc. Civil Application stands allowed.

(ii) The proceedings of Hindu Marriage Petition No.A-1202/2024, pending before the learned Judge, Family Court-6, Pune stands transferred to the Court of learned CJSD, Omerga Dist. Dharashiv/Osmanabad.

(iii) After transfer of the proceeding, the applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal with

( 3 ) such application, so as to compensate the respondent-husband, if he personally remains present.

(iv) Whenever request is made by the respondent-husband seeking permission to appear through video conferencing, the same shall be considered liberally by the trial Court.
