ORDER:- 1.

Leave to correct the Marriage Petition Number as "277" instead of "227".

Heard learned Counsel for the applicant - wife. The respondent husband, though served with notice, but remained absent.

The applicant - wife is seeking transfer of Marriage Petition No. A/277 of 2022 filed by respondent - husband for restitution of conjugal rights, from the Family Court, Nanded to the Family Court, Parbhani.

According to the applicant-wife, she is not having any independent source of income. , she has also filed proceedings under the provisions of Protection of Women from Domestic Violence Act, 2005 and proceeding under Section 125 of the Code of Criminal Procedure against the respondent - husband at Parbhani. There is no oppose to the application and the respondent will have to appear in the proceedings filed by applicant wife at Parbhani. Therefore, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) The Marriage Petition No.A/277 of 2022 pending in the Family Court, Nanded is transferred to the Family Court, Parbhani for its simultaneous disposal alongwith Petition E.No. 130 of 2022 pending therein.

(iii) The respondent is directed to appear before the learned Family Court, Parbhani on or before 15th July 2023.

(iv) The application is disposed of accordingly.
