Heard the learned Counsel for the respective parties. 2.

The petitioner challenges the order dated 27.08.2023 passed below Exh. 6 by the learned Member Industrial Court, Latur. 3.

Mr. Deshmukh, learned Counsel for the petitioner submits that though the order was passed in the year 2013, no any communication was received by the Municipal Council, Osmanabad. Therefore, the order was challenged in the year 2022 by filing the present petition.

As the the order is challenged in the year 2022, it shows that the Municipal Authority is not diligent to prosecute the matter. Despite of service of notice nobody appeared on behalf of petitioner before the Member Industrial Court, Osmanabad and the matter proceeded ex-parte without Written Statement.

The employee has filed the complaint in the year 2011 and it was decided in the year 2013. From 2013 to 2022 and afterwards from 2022 till today the Municipal Council has not pursued the matter diligently.

In view thereof, I am not inclined to entertain the present Writ Petition, therefore, the same is dismissed. No order as to the costs. (SIDDHESHWAR S. THOMBRE, J.) mahajansb/
