Heard learned Counsel appearing for the respective parties.

Considering the averments made in the present application and the defences taken by the Insurance Company in the memo of appeal, I deem it appropriate to allow the present applicant to withdraw fifty per cent of the amount deposited by the appellant before the Workmen's Compensation Commissioner on submitting an undertaking that in the event any adverse order is passed, the applicant shall re-deposit the amount so withdrawn by him within two weeks next after such order is passed. Civil Application stands disposed of.
