Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

After an endeavour to get anticipatory bail for two years, the applicant surrendered. He undergone five days in police custody remand, but nothing has been recovered from him. The applicant has a case that the main accused and the first informant have a civil dispute. He is a friend of main co-accused. Hence, he has been arraigned as an accused. The false allegations of taking away money from the table from the house, have been levelled against him to make the offence serious. The other co-accused has already been released on bail.

Perused the papers. It appears that the material investigation against the applicant has been completed. It is not in dispute that the main accused and the first informant have a civil dispute over the land. In the facts and circumstances of the case, further detention of the applicant would not serve the purpose. Hence, the order :- i) The application is allowed.

ii) Applicant Shahabaz Khan s/o. Qadeer Khan be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.427 of 2023, registered with Jinsi Police Station, District Aurangabad, for the offences punishable under Sections 449, 395, 427, 504 and 506 of the Indian Penal Code, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall not involve in the similar crime.
