BENCH AT AURANGABAD PUBLIC INTEREST LITIGATION NO. 16 OF 2015 Namdeo S/o Nivratti Sanap .. Petitioner VS.
The State of Maharashtra and others .. Respondents ---- Mr. U.R. Awate, Advocate for the petitioner Mr. S.B. Yawalkar, A.G.P. for the respondent/State Mr. P.D. Suryawanshi, Advocate for respondents 2 to 6 ---- CORAM : S.C. DHARMADHIKARI & MANGESH S. PATIL, JJ.
DATE : 29-06-2017 ORAL ORDER :
1.
After the affidavit was filed in this Petition and in reply to the allegations, we enquired from the petitioner's Advocate as to how the High Court can go on monitoring and ensuring supply of clean drinking water to some villagers.
2.
Eventually, this Court has to rely upon public officials and incharge of implementation of such schemes and particularly
2 PIL - 16-2015 for supply of drinking water. It is true that people like the present petitioner has grievances about their working and functioning and the quality of the work at site. However by that alone, we cannot presume that none is doing the job or that purposefully and deliberately, a particular village is deprived of pure drinking water. 3.
Apart from this, the affidavit-in-reply discloses that other avenues have been explored and presently clean drinking water is provided through hand pumps. As far as the query from the Court, why when the well already is dug up and had water but the same is impure, steps have not been taken to purify it and by scientific method. It is stated that the machine and particularly utilised for cleaning and purifying the drinking water in the well is to be fixed and said work will be completed within two months from today. 4.
We accept the statement made on instructions by the Advocate for the respondents 2 to 6 as an undertaking to this Court.
3 PIL - 16-2015 5.
We dispose of the Public Interest Litigation. However, endeavour should be made and from every source to provide pure and clean drinking water to the subject village. [MANGESH S. PATIL] [S.C. DHARMADHIKARI] JUDGE JUDGE arp/
