The petitioner original defendant has come to this court challenging the judgment and order passed by the learned District Judge, Latur dismissing his MCA. The challenge is raised to interim order passed by the Joint CJJD, Latur dated 18-09-

(2) 33wp3052.25 2019 below Exh.5 in RCS No. 296/2019. The application of the plaintiff is allowed by the learned trial Judge. Thus, interim relief is running against the petitioner since 18-09-2019. It would not be appropriated to disturb the said order pending the suit. It would be suffice to direct the trial court to expedite the suit as the suit is of 2019.

The petition thus stands disposed off.
