Petitioner who claims to have been appointed on a part time basis and continued as such till 31-05-2015 and was made permanent thereafter with effect from 01-06-2015, is awaiting allotment of the G.P.F. account.

Learned advocate for the petitioner takes us through the decision of this Court including that of Full Bench in the matter of Deshmukh Dilipkumar Bhagwan and others Vs. State of Maharashtra (writ petition no. 8387 of 2013 - Bombay) and submits that as per the government resolution dated 01-11-2005 he has been in employment in 100% grant in aid since therefore, he would be covered by the old pension scheme, however, his request for allotment of G.P.F. account is not being considered pursuant to the

2 WP / 2826 / 2020 proposal dated 15-09-2018 forwarded by the headmaster (Exhibit - E). The matter is pending with respondent no. 6.

Without commenting upon the merits of the petitioner's entitlement, we dispose of the writ petition keeping open all the issues and directing respondent no. 6, to respond to the proposal received from the headmaster (Exhibit - E) in accordance with law, as expeditiously as possible and in any case within six (6) weeks.
