The petitioner's proposal regarding additional posts of teachers was pending with the respondent - Education Officer. Since no steps were being taken pursuant to the Government Resolution the petitioner had approached this Court in Writ Petition No. 8119/2016. By the order dated 23.11.2017 this Court had directed the authorities to take appropriate 1/2
936.WP.5055.19.odt decision on the petitioner's request since in the affidavit-in-reply filed in that it was expressed that it was merely due to non-availability of the class rooms that the request was not being considered.

It transpires during the course of the argument that though by the impugned order the Education Officer (Secondary) has refused to grant approval, simultaneously as has been pointed out by the learned AGP relying upon the affidavit-in-reply that the Education Officer (Secondary) has submitted a detail report to the Director of Education (Secondary and Higher Secondary) on 09.09.2021. The learned advocate for the petitioner submits that the petitioner's grievance would be sorted out if a direction is issued to the respondent No.2 to consider this report and take appropriate decision.

We dispose of the writ petition by directing the respondent No.2 to take appropriate decision on the report submitted by the Education Officer (Secondary) Zilla Parishad, Osmanabad dated 09.09.2021 (Exhibit - R-3) as expeditiously as possible and in any case within eight weeks.
