ORDER:

Issue notice to the respondents. Learned Asst. Government Pleader waives service of notice for respondents No. 1, 2 and 3. Mrs Vaishali Choudhari, learned counsel, accepts notice for respondent No. 4.

The learned counsel for the petitioner submits that, the validation proceeding is pending with the Committee and in December-2017 this Court has remitted the matter to the Committee. The vigilance is already conducted. Even the hearing was conducted earlier. The result of Third (2) MBBS Winter examination is
2 Sr921 WP2235.2018 withheld. The learned counsel submits that, even otherwise the petitioner will have to undergo internship before issuing the Degree Certificate.

Considering the above conspectus of the matter, we pass the following order.
ORDER
(i) The respondent No. 2 - Committee shall decide the tribe claim in respect of the petitioner within a period of four months from today.
(ii) Considering the fact that, the vigilance is already conducted, the petitioner shall appear before the Committee on 08.03.2018.
(iii) The petitioner shall cooperate with the Committee in expeditious disposal of the proceeding.
(iv) Respondents No. 3 and 4 shall not withhold the result of the petitioner only on the ground that the validation proceeding is pending. Of course, the petitioner shall not be issued with the
3 Sr921 WP2235.2018 Degree Certificate unless and until the petitioner produces the validity.
