Admittedly, there is nothing against Applicant No.2 to indicate his involvement in the alleged crime. His application is therefore allowed. 3.

So far as Applicant No.1 is concerned, his involvement in the offence in question is writ large. The Court is, therefore not inclined to grant him relief.

Learned counsel for the applicants, therefore came around to seek leave to withdraw the application for Applicant No.1. 1 / 2

Hence, the following order :-

ORDER

(I) Application is partly allowed.

(II) Application of Applicant No.1 - Anand Ramesh Tamboli is disposed of as withdrawn.

(III) In the event of arrest of Applicant No.2 - Tinu @ Chandrakant Ramesh Tamboli, in connection with Crime No. 796 of 2022 registered with Nandurbar City Police Station, Dist. Nandurbar for the offences punishable under Sections 409, 379 and 381 of the Indian Penal Code, he be released on executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety in the like amount.

(IV) He shall appear before the investigating officer, as and when required for the investigating purpose.
