1) Both the sides are present. They submit that the parties have settled the dispute before the Mediator. Terms of settlement are signed by the parties, they are on record. The parties are identified by their respective Advocates. Learned counsel for the plaintiff submits that as per the settlement, amount is already received by the original plaintiff. In view of these submissions the judgment and decree of the trial Court is modified and that is to be drawn in terms of the settlement. In those terms the appeal is disposed of.
