Heard Mr. M.M.Bhokarikar, learned counsel for the petitioners and learned A.G.P. for respondent nos. 1 to 3.

Learned counsel submits that the petitioner has already relieved respondent no.4 and respondent nos. 1 to 3 are required to take steps to absorb respondent no.4. Learned counsel further submits that the Education Officer has already passed the order as against respondent no.4 to join another school.

It is submitted by learned counsel and it is also stated in the Writ Petition that respondent no.4 has already filed Writ Petition against the order declaring respondent no.4 as surplus and this Court has ordered status-quo to be maintained.

When respondent no.4 has already challenged the said order declaring respondent no.4 as surplus and directing her to be absorbed in some other school, then there cannot be any contrary order in other Writ Petition. The petitioner is also party in the said Writ Petition. The petitioner may put forth his case in the pending Writ Petition.

Writ Petition accordingly disposed of with the aforesaid clarification. No costs.
