Per Court :- Present Criminal Application is filed by the applicants for grant of anticipatory bail, since they are apprehending their arrest in connection with CR No. I 34/2015 registered with Police Station, Shevgaon, Dist. Ahmednagar for the offences punishable under Section.s. 324, 323, 506 of the Indian Penal Code, 1860 and under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and under Section 7(1)(d) of the Protection of Civil Rights Act, 1955.
[2] Heard Mr. B.P. Dhanure, learned counsel for the Applicants and Mrs. V.A. Shinde, Additional Public Prosecutor for the State of Maharashtra.
2/3 [3] The First Information Report is completely silent about the role of the present applicants in respect of utterances of abusive words in the name of caste. First Information Report shows that, utterances was by father of the present applicants and not by present applicants that leads me to pass following order :-
ORDER
(i) Criminal Application is allowed.
(ii) In the event of arrest, applicant No.1 Ramkisan Babasaheb Thorve and Applicant No.2 - Arun Babasaheb Thorve shall be released on anticipatory bail on they executing P.R. Bond of Rs. 5000/- [Rs.Five Thousand] each with one solvent sureties in the like amount, in connection with CR No. 34/2015 registered with Police Station, Shevgaon, Dist. Ahmednagar for the offences punishable under Section.s. 324, 323, 506 of the Indian Penal Code, 1860 and under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and under Section 7(1)(d) of the Protection of Civil Rights Act, 1955.
(iii) The applicants shall attend the Police Station, Shevgaon Dist. Ahmednagar once in a fortnight preferably on Sunday in between 3.00 p.m. to 4.00 p.m., till filing of the Charge-Sheet.
