Learned Advocate for the applicants Mr. Bide submits that these applications are filed for condonation of delay caused in filing these first appeals. The appeals are filed by the original claimants for enhancement of the amount of compensation. The acquiring body has also filed appeals challenging the same judgment and award bearing First Appeal St.Nos. 34966, 35122, 35126, 35132, 35135, 35138, 35129 of 2021, in which this Court has already condoned the delay by order dated 21.07.2022.

The civil applications are objected by the respective learned Standing Counsel and learned AGP for the respondent-State. 03.
Considering the aspect that the respondents have also filed appeals and for the reasons stated in the applications, the delay stands condoned. The applications are allowed subject to following conditions. (i) The applicants shall deposit costs of Rs.1000/- in each matter with the High Court Legal Services SubCommittee, Aurangabad, within two weeks from today. (ii) The applicants/claimants shall not be entitled to the interest for the delayed period on the enhanced amount of compensation in case the appeals are allowed and the applicants shall submit specific undertaking to that effect.
