The petitioner is aggrieved by the order of the Additional Divisional Commissioner dated 09.01.2019 vide which, he has declined to grant an interim protection to the petitioner, who has been disqualified on account of the encroachment by the order of the District Collector dated 06.12.2018.

I have heard the learned advocate for the petitioner and the learned AGP on behalf of respondent nos.1 and 2. I find that almost five months have passed-by post the impugned order of the Additional Divisional Commissioner dated 09.01.2019. It would be in the interest of justice to direct the Additional Divisional Commissioner to decide Appeal No.138/2018 expeditiously. All

*2* 13wp4063o19 the parties have appeared before the said authority and the next date of hearing is posted on 18.06.2019 at Aurangabad. In view of the above, this Writ Petition is disposed off. The litigating sides would advance their oral submissions and would also be at liberty to file their written notes of submissions on 18.06.2019 or on or before 20.06.2019. The Additional Divisional Commissioner shall, thereafter, close the matter for passing orders. It is expected that the Additional Divisional Commissioner would pass a reasoned order on or before 15.07.2019 by intimating the litigating sides the date on which he would pronounce his order.
