A request is made for modification of order to the extent of cost that is imposed. The learned counsel for the applicant submits that, the applicant is not in a position to deposit the said amount of cost as he is an agriculturist.

We have heard Mr. Tele, the learned counsel for the non applicant No. 1.

This Court partly allowed the writ petition and granted

2 ca 3458.15 opportunity to the applicant on payment of cost. Considering the laxity on the part of the applicant and considering number of times the applicant was absent the cost is imposed. This Court had taken liberal view of granting one more opportunity to the petitioner. Considering the above, the civil application is rejected. No costs.
