PER COURT :

1) Mr. Patil the learned counsel submits that, appointment of petitioner as Hostel Superintendent is already approved. According to authorities the said post is required to be approved by the Government. Even recommendation is made and proposal is submitted by the respondent No. 2 to respondent No. 1 on 11.09.2014 but no decision is taken as yet. The learned counsel submits that, because of inaction on the part of respondent No. 1 to decide the said proposal the salary is not paid.

2 WP2243.15 2) Mr. Patil the learned Additional Government Pleader submits that, in case the said proposal is pending the respondent No. 1 would decide the same on its own merits. 3) In light of the above, we pass the following order -

ORDER

A) The respondent No. 1 shall decide the proposal forwarded to it by respondent No. 2 (Page-94) on its own merits in accordance with law expeditiously, preferably within three (3) months.

B) In case the said proposal is decided by the State favourable to the petitioner then the petitioner would be entitled to further monetary benefits.
