The petitioner is challenging the construction permission on the basis of P.R. Card issued in favour of respondent no.4.

The dispute appears to be between the private persons on and over the private property. 3.

The disputed questions of fact exist. It would not be open to entertain the disputed questions of fact in writ jurisdiction under Article 226 of the Constitution of India.

In view of that, writ petition is disposed of with liberty to the petitioner to avail the alternate remedy as may be permissible under law. No costs.
