Heard learned Counsel for the applicant. The respondent, despite service, remained absent. The applicant-wife is seeking transfer of Petition No.A-496 of 2020 fled by the respondent-husband for getting divorce, from Family Court, Nasik to competent Court at Rahata i.e. Court of Civil Judge, Senior Division, Rahata, District Ahmednagar.

According to the applicant, she is not having any

{2} independent source of income. Moreover, she is looking after three minor daughters without any fnancial assistance from the respondent. Moreover, she has also fled proceedings for getting maintenance under Section 125 of the Code of Criminal Procedure against the respondent wherein he has already appeared.

There is no oppose to this application. Since the respondent is already attending the dates at Rahata, the petition fled by him can conveniently be transferred to Rahata from Nasik.

In view of the same, following order is passed: (A) Misc. Civil Application is allowed.

The Petition No.A-496 of 2020 is hereby transferred to the Court of Civil Judge, Senior Division, Rahata, District Ahmednagar from the Family Court, Nasik, for disposal according to law.

{3} (B) The Respondent is directed to appear before the Civil Judge, Senior Division, Rahata, on or before 1st April, 2023.
