PER COURT :- The application for review of the order passed by the Additional Commissioner on 11.10.2007, has been turned down by the concerned authority, holding that, the application, seeking review of the order is not entertainable. The proceedings before the Additional Commissioner are in respect of disqualification of the Member of the Zillha Parishad under the provisions of The Maharashtra Zilha Parishads & Panchayat Samitis Act, 1961. The application seeking review of the order is presented under section 258 of The Maharashtra Land Revenue Code, 1966. The aforesaid provision of the Code is inapplicable and there is no provision in respect of review of the order passed by the concerned authority under the provisions of Maharashtra Zillha Parisahad & Panchayat Samitis Act, 1961. The view taken by the Additional Commissioner cannot be said to be erroneous.

The writ petition is devoid of substance and stands disposed of. ( R. M. BORDE, J. ) vbd
