The prayer of the petitioner is for deciding the application dated October 10, 2022 which was moved to the Prohibition Officer i.e. District Collector, Nanded seeking shifting of CL-III license in view of the landlord-tenant disputes. 2.

Learned A.G.P. in response to the Court's query on instructions informs that the application is already decided by the respondent-Prohibition Officer and the petitioner can attend the office of the Prohibition Officer i.e. District Collector, Nanded or Superintendent of State Excise, Nanded on 30th March, 2023 for collecting the copy of such order of rejection. 3.

In view of the aforesaid submission of the the learned A.G.P. nothing survives in the petition. Writ Petition accordinlgy stands disposed of.

Needless to clarify that, in case the adverse order is passed against the petitioner by the District Collector, Nanded, it shall be open for him to take recourse to the appellate remedy available under the Maharashtra Prohibition Act.
