The petitioner cannot be governed by old pension scheme as the new pension scheme enforced on 01.09.2005 shall apply to him. The petitioner desires to take benefit under Defined Contributory Pension Scheme (DCPS) and as such, seeks to withdraw the petition with a liberty to apply for pension under the DCPS. The petition is as such disposed of with a liberty to the petitioner to claim pensionary benefits as per DCPS.
