The present application is pending since 2021. Learned APP submitted a report of the Investigating Officer. The Investigating Officer has made the statement that till this date, no crime is registered against the applicant. However, the applicant has an apprehension of arrest in the crime, which may likely to be registered in near future. The Investigating Officer has also informed that notice under Section 160 of the Cr.P.C. was served upon the applicant but he did not appear. 2.

The learned counsel for the applicant would submit that since the notice was issued, he got an apprehension of his arrest. The fact remains that the offence is not registered. But, a report against the applicant has been given to Police Station

Hence, the application is disposed of with a direction to the Investigating Officer, if any crime is registered against the applicant on the report dated 21.03.2021, 48 hours, notice shall be given to the applicant before his arrest, if any.
